This agreement defines your rights, responsibilities, and available remedies in the event of legal, technical, or service-related disputes while using services provided by Smart Hostee Labs, Inc.
By accessing or using our services, you agree to comply with and be bound by the terms outlined below.
Account Eligibility
By registering with Smart Hostee Labs, Inc. or using any of our services, customers acknowledge and agree to the following conditions:
- Our services are strictly available to individuals who are 18 years of age or older. Accounts found to be operated by minors will be terminated immediately.
- If a customer registers or purchases services on behalf of a third party, the registering customer confirms that the third party is also bound by these Terms and is responsible for ensuring their compliance.
- Customers are solely responsible for maintaining the confidentiality and security of their account credentials. Any unauthorized access or resulting damages due to poor credential management are the customer’s responsibility.
- Users must provide accurate, current, and complete registration information. Failure to do so may result in account suspension or termination.
- Smart Hostee Labs, Inc. may request identity or payment verification, including credit card verification. Failure to comply may result in account cancellation.
- We reserve the right to request additional verification documentation at any time. Failure to provide requested documents may lead to suspension or termination of services.
- Only customers who agree to comply with all applicable local, national, and international laws are permitted to use our services. Illegal, abusive, or unethical use is strictly prohibited.
Prohibited Activities
Smart Hostee Labs, Inc. strictly prohibits the following activities and reserves the right to suspend or terminate any account engaging in them:
- IRC servers or related services
- Automated browsing tools, traffic exchanges, bots, or similar software
- Illegal downloads/uploads, pirated content, or warez
- Hacking tools, brute-force programs, IP scanners, or port scanning
- Email spamming or unsolicited bulk messaging
- Fraudulent financial schemes (HYIP, Ponzi schemes, Forex scams, etc.)
- Gambling, lottery, or betting websites
- Public VPNs, proxies, anonymizers, or TOR exit nodes
- Cryptocurrency mining or similar resource-intensive activities
- Phishing, malware distribution, or fraudulent websites
- File hosting or illegal streaming services
- Adult content or sexually explicit material
- Activities causing excessive server load or network instability
- Attempts to bypass security controls or gain unauthorized access to systems
Usage Policy
- Unlimited bandwidth is provided for normal website usage. Excessive usage (e.g., exceeding 15GB per day on shared hosting) may require a service upgrade.
- “Unlimited” resources are intended for personal and small business websites and must not be used for file storage, backups, or abusive purposes.
- Any activity negatively affecting server performance, uptime, or stability may require migration to VPS or dedicated server services.
- All reseller hosting accounts are limited to 200 outgoing emails per hour per cPanel account to prevent abuse and ensure server reliability.
Reseller Terms & Client Responsibilities
- Resellers are fully responsible for ensuring that their clients comply with all Smart Hostee Labs, Inc. policies.
- Reselling shared hosting accounts is strictly prohibited. Resellers must use approved reseller hosting plans.
- Resellers are responsible for providing customer support, billing, and service management to their clients.
- Smart Hostee Labs, Inc. is not liable for disputes, damages, or service issues between resellers and their clients.
- We reserve the right to review, modify, or discontinue reseller plans at our discretion.
- Any reseller cPanel account found violating these Terms will be permanently suspended or terminated.
- If a reseller account receives an abuse report from a data center or upstream provider, it may be suspended or terminated.
- If a reseller’s client accounts are flagged for abuse more than three (3) times within a single month, the reseller’s account may be suspended or terminated.
Secure Shell (SSH) Access Terms
- SSH access is disabled by default and may be enabled upon request with valid justification.
- Any abuse or misuse of SSH privileges will result in immediate account termination.
Outgoing Traffic & Spam Policy
- Accounts found sending spam, phishing, or fraudulent emails will have outbound email services immediately blocked.
- Repeated violations will result in permanent suspension or termination of services.
Network & Server Cleanliness
Smart Hostee Labs, Inc. is committed to maintaining a secure, clean, and stable hosting environment. We actively monitor and protect our servers, IP addresses, and network infrastructure against spam, abuse, and malicious activities to ensure optimal performance for all customers.
Changes to the Terms of Service (TOS)
We may update these Terms of Service periodically to reflect changes in business operations, service offerings, or legal and regulatory requirements. Any updates will be published on this page, with the revised effective date clearly stated.
Customers are encouraged to review these Terms regularly to remain informed of their rights and obligations.
