Smart Hostee Labs, Inc. (“Smart Hostee,” “we,” “our,” or “us”) provides hosting and related services to customers worldwide. We are committed to protecting our infrastructure, our customers, and the integrity of our network. This Acceptable Use Policy (AUP) defines acceptable and unacceptable uses of our services.
Smart Hostee Labs, Inc. reserves the sole right to determine what constitutes a violation of this policy.
General Use
All services provided by Smart Hostee Labs, Inc. may be used for lawful purposes only.
The transmission, storage, or publication of any content or material that violates applicable local, national, or international laws or regulations is strictly prohibited.
The customer agrees to indemnify and hold harmless Smart Hostee Labs, Inc. from any claims, damages, or liabilities arising from the use of our services.
Prohibited Content
The following content is strictly prohibited, including but not limited to:
- Copyrighted material without authorization
- Unlicensed or pirated software
- Cracking tools, key generators, or license bypass tools
- Brute-force attacks, DDoS attacks, or similar activities
- High-Yield Investment Programs (HYIPs), Ponzi schemes, or scam platforms
- Child exploitation, abuse material, or kidnapping-related content
- Fraud, phishing, pyramid schemes, impersonation, or forgery
- Terrorist propaganda, extremist material, or weapon/bomb instructions
- Viruses, spyware, malware, ransomware, or malicious code
- Trade-secret–protected or legally restricted material
- Adult or sexually explicit content
- Dating platforms, hacking forums, or abuse-focused communities
- Torrents, warez, illegal streaming, or file-sharing services
- Using shared hosting for bulk file storage or backup repositories
Additionally Prohibited Activities
Smart Hostee Labs, Inc. also prohibits:
- IRC servers and related applications (including bots or bouncers)
- Game servers, voice servers, or similar real-time services
- Scripts designed for abuse, flooding, or exploitation
- Threatening, harassing, defamatory, or obscene content
- Linking to prohibited content, whether hosted locally or externally
Violations may result in immediate suspension without prior notice.
Online Activity & Network Abuse
Any attempt to interfere with, disrupt, or harm Smart Hostee Labs, Inc. infrastructure, network, or customers is strictly prohibited.
This includes, but is not limited to:
- Denial-of-Service (DoS/DDoS) attacks
- Port scanning or network probing
- Mail bombing
- Unsolicited advertising (email, forums, IM, newsgroups)
- Any form of hacking or exploitation
Smart Hostee Labs, Inc. reserves the right to pursue legal action and recover damages caused by abusive activity.
Bulk Email & Spam Policy
Unsolicited bulk email (spam) is strictly prohibited.
Legitimate bulk email must meet all of the following criteria:
- Recipients have explicitly opted in (verifiable consent required)
- Messages contain valid headers, sender identification, and unsubscribe instructions
- Privacy policies are publicly available and clearly disclosed
- Proof of consent must be provided within 24 hours upon request
Failure to comply may result in immediate termination.
If spam activity causes IP or mail server blacklisting, Smart Hostee Labs, Inc. reserves the right to suspend services and recover remediation costs.
Policy Enforcement & Violations
Smart Hostee Labs, Inc. reserves the right to:
- Audit systems and accounts upon suspicion of violations
- Suspend or terminate accounts immediately
- Deny backups for accounts violating this AUP
Resellers are fully responsible for the actions of their clients.
Warnings & Notices
Where appropriate, Smart Hostee Labs, Inc. may issue warnings via email as a courtesy.
- Customers must respond within 24 hours
- Failure to respond may result in suspension
- Repeated non-compliance may result in termination
Suspension & Termination
Violation of this policy may result in:
- Immediate suspension
- Permanent termination
- Loss of all data
- Forfeiture of any refunds or advance payments
Smart Hostee Labs, Inc. reserves the right to terminate any account or reseller account without prior notice.
Unauthorized Usage
Customers are responsible for securing their services.
If abuse originates from compromised systems, the customer must immediately:
- Stop affected services
- Identify and resolve the source of abuse
Smart Hostee Labs, Inc. may suspend all services until the issue is resolved.
Resource Usage
Accounts that cause excessive load or consume more than their allocated resources may be suspended without notice.
Overuse includes but is not limited to:
- CPU abuse
- Memory exhaustion
- Disk I/O saturation
- Excessive concurrent processes
Anti-Nulled Scripts Policy
Nulled, cracked, or pirated themes, plugins, and scripts are strictly prohibited.
If detected:
- The account will be suspended immediately
- Proof of purchase must be provided for reactivation
Failure to provide valid proof will result in permanent termination.
Unlimited Disk Space Policy
“Unlimited” disk space and bandwidth are subject to fair usage.
- A single cPanel account may not exceed 10 GB of disk usage
- Storing unrelated backups, audio/video archives, or large datasets is prohibited
Abusive usage may result in restrictions or suspension.
Bandwidth Usage
Bandwidth overages may incur additional charges unless the service is explicitly unmetered.
- VPS and server services sold by MBPS are calculated using the 95th percentile method
- Customers are responsible for usage resulting from hacking or flooding incidents
- Deposits may be required for unusually high bandwidth usage
Backup Policy
- Shared & reseller hosting accounts:
- Below 5GB: daily backups
- Above 5GB: weekly backups
- Only the latest two backups are retained
- VPS and dedicated servers are not backed up
Backups are provided as a courtesy, not a guarantee.
Filtering & Traffic Management
Smart Hostee Labs, Inc. may block, throttle, or filter ports, protocols, or IP ranges to protect network stability (e.g., IRC ports, P2P traffic, known spam sources).
Virtual Private Servers (VPS)
VPS accounts consuming excessive resources may be:
- Required to upgrade
- Migrated to another node
- Suspended to maintain platform stability
Abusive Clientele
Smart Hostee Labs, Inc. may suspend or terminate services for abusive behavior, including:
- Verbal abuse or threats
- Repeated policy violations
- Excessive support abuse
- Chargebacks or payment reversals
- Ongoing abuse-related incidents
- Activities affecting other customers
Final Notice
Failure to comply with this Acceptable Use Policy may result in immediate service suspension or termination without refund.
